Please read these Terms of Service carefully before using WarmSpeech. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account and using WarmSpeech, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

2. Description of Service

WarmSpeech is a conversation practice and coaching tool that helps users improve their communication skills through AI-powered practice sessions and personalized feedback.

Important Notice:

WarmSpeech is NOT a mental health service, therapy, or crisis intervention tool. It is designed for communication skills practice only. If you are experiencing a mental health emergency, please contact emergency services or visit our Support page for crisis resources.

3. Eligibility

You must meet the following requirements to use WarmSpeech:

• Be at least 13 years of age (or 16 in the European Economic Area)

• Have the legal capacity to enter into a binding contract

• Not be prohibited from using our service under applicable laws

• Provide accurate and complete registration information

4. Account Registration and Security

When you create an account, you agree to:

• Provide accurate, current, and complete information

• Maintain and update your information to keep it accurate

• Maintain the security and confidentiality of your login credentials

• Notify us immediately of any unauthorized use of your account

• Accept responsibility for all activities under your account

You may not share your account, use another user's account without permission, or create multiple accounts to abuse our service.

5. Subscription and Payment

• Subscriptions automatically renew unless cancelled before the renewal date

• You authorize us to charge your payment method for recurring subscription fees

• Prices may change with 30 days advance notice; changes apply at next renewal

• You can cancel your subscription at any time from your account settings

• Refunds are available within 30 days of initial purchase (see section 6)

• No refunds for partial subscription periods after the 30-day window

6. Cancellation and Refunds

30-Day Money-Back Guarantee: If you're not satisfied within the first 30 days of your initial subscription, contact us at hello@warmspeech.com for a full refund.

After 30 days, you may cancel at any time but will not receive a refund for the current billing period. Your access will continue until the end of the paid period.

7. Acceptable Use

You agree NOT to:

• Use the service for any illegal or unauthorized purpose

• Violate any laws in your jurisdiction

• Transmit malware, viruses, or harmful code

• Attempt to gain unauthorized access to our systems

• Reverse engineer, decompile, or disassemble the service

• Scrape, crawl, or harvest data from the service

• Use automated systems to access the service without permission

• Impersonate any person or entity

• Harass, abuse, or harm other users

• Share content that is illegal, offensive, or violates others' rights

8. Intellectual Property

WarmSpeech, including all content, features, functionality, and design, is owned by WarmSpeech and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your conversation content, but grant us a limited license to use, store, and process it to provide the service and improve our AI models. You can delete your content at any time.

9. AI-Generated Content

WarmSpeech uses artificial intelligence to generate coaching feedback and conversation responses. AI-generated content may not always be accurate, appropriate, or helpful. You should:

• Exercise independent judgment when reviewing AI feedback

• Not rely solely on AI coaching for important decisions

• Report any harmful, offensive, or inappropriate AI responses

• Understand that AI has limitations and may produce errors

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be uninterrupted, secure, or error-free

• Results from using the service will be accurate or reliable

• Defects will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARMSPEECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless WarmSpeech from any claims, damages, losses, liabilities, and expenses arising from your use of the service, violation of these terms, or violation of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service

• Fraudulent or illegal activity

• Abuse of the service or other users

• Non-payment of subscription fees

Upon termination, your right to use the service immediately ceases. You may also terminate your account at any time by contacting us or deleting it from your account settings.

13. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or a prominent notice in the service at least 30 days before taking effect. Continued use of WarmSpeech after changes become effective constitutes acceptance of the new terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these terms or the service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
